Auction Terms

These terms govern the auction relationship between users placing bids ("Bidder") on the yachtbidding platform ("Platform") and the platform operator Bella International Yacht Brokerage Turizm Tic. Ltd. Şti. ("Company"), and form an integral part of the User Agreement. The Company is not the owner of the listed yachts; it acts as a broker on behalf of the seller.

1. Bid Access

Membership and bidding are free of charge; to place a bid you must create an account and verify your e-mail address. Your account is personal: every bid placed from your account is deemed your bid, and you are responsible for any consequences of third parties using your account.

2. Listings and Sale "As Is"

Listings are prepared with care; however, obvious typing and material errors in a listing do not bind the Company or the seller. The yacht is offered for sale "as is, where is", without any warranty. Before bidding you are entitled to request an inspection and a sea trial; bidding without inspecting the yacht is entirely at your own risk.

3. Bidder's Responsibilities

The Bidder confirms being at least 18 years old and having legal capacity, undertakes not to bid on a yacht owned even partly by the Bidder (no shill bidding), and agrees to use seller information solely in connection with the auction and sale process. The Bidder is liable for third-party claims arising from misuse of the Platform.

4. How the Auction Works

The start and close of the auction are stated in the listing; bids can only be placed within this period. The currency is shown in the listing. Any bid placed within the final 3 minutes extends the auction by 3 minutes (anti-sniping). A bid is binding and cannot be withdrawn or modified.

5. Removal of Bids and Suspension of the Auction

The Company may remove or invalidate a bid in case of suspected fraud or abuse, reasonable belief that the bid is an obvious mistake, breach of payment obligations, or technical failure. If the yacht is damaged, stolen or lost, or in case of misuse or technical failure, the Company may pause, postpone or cancel the auction; the Company cannot be held liable for losses arising from this.

6. Reserve Price and Seller Approval

A yacht may be offered with a confidential minimum sale price (reserve); the existence of a reserve is stated in the listing. If the highest bid meets the reserve, the purchase agreement is formed automatically. If the reserve is not met, the seller is not obliged to sell; however, the seller may complete the sale by approving the highest bid within 48 hours of the close of the auction.

7. Formation of the Purchase Agreement

The purchase agreement is formed when the yacht is allocated to the Bidder, and the outcome is notified by e-mail; at that moment the Bidder becomes the "Buyer". The Buyer is obliged to pay the sales price (the winning bid) and the auction fee in accordance with the Payment Terms, and to complete the purchase.

8. Governing Law

These terms are governed by Turkish law; the courts and enforcement offices of Fethiye have jurisdiction over disputes.
